How PodKolay collects, uses, and shares information when you use our website and creative tools.

1. Overview

This Privacy Policy explains how PodKolay ("PodKolay", "we", "us", or "our") handles information when you use our website, dashboards, and creative tools (collectively, the "Service").

The Service is built as an orchestration layer: many features rely on independent third-party providers (for example, AI processing, storage, and payments). As a result, your inputs and outputs may be processed outside of PodKolay’s infrastructure.

2. Who We Are

PodKolay is operated by an individual (a sole operator) and is not presented as a registered company or legal entity.

If you need to contact us about privacy, you can reach us at support@podkolay.com. We do not provide a public mailing address at this time.

3. Data We Collect

3.1 Account and profile data

  • Email address and account identifiers (e.g., user ID).
  • Plan/entitlement metadata (e.g., plan ID, subscription status, credits balance).
  • Optional integration identifiers (e.g., Telegram chat ID if you opt in).

3.2 Content you upload or submit

  • Images and files you upload for processing.
  • Inputs, prompts, selections, and settings you provide to run tools.
  • Outputs returned by third-party processing providers (generated/upscaled/processed media).

Do not upload sensitive personal data (e.g., government IDs, health data) or any content you do not have rights to use.

3.3 Usage, diagnostics, and security data

  • Feature usage events (e.g., credit consumption, job starts, limits reached).
  • Approximate device/browser information and logs used to keep the Service reliable and secure.
  • IP address may be processed for abuse prevention and operational security.

3.4 Payment data

Payments are processed by Lemon Squeezy as a Merchant of Record ("MoR") and may also be processed by other third-party payment processors (for example, Mor) depending on the checkout method you use. PodKolay does not store your full payment card details. These providers may collect billing details, tax information, and payment method data to process purchases and comply with legal obligations.

4. How We Use Data

We use information to:

  • Provide and operate the Service (authentication, credits, limits, and tool execution).
  • Process your content through third-party providers when you request an action.
  • Prevent abuse, enforce limits, protect accounts, and maintain security.
  • Provide support and respond to your requests.
  • Improve reliability and user experience (debugging, performance tuning).

5. Sharing & Service Providers

We share information only as needed to provide the Service, comply with law, protect rights, or complete transactions you request. Categories of recipients may include:

  • Authentication and database providers (to store accounts, profiles, credits, and usage logs).
  • Storage and delivery providers (to temporarily host uploads and deliver files needed for processing).
  • Payment providers / MoR (Lemon Squeezy; and, where applicable, Mor) to process purchases, taxes, and billing.
  • AI processing providers (to run image processing and generation workloads you request).

6. AI Processing (Third Parties)

When you use creative tools, your content (such as an uploaded image and the settings you choose) may be transmitted to third-party AI providers to perform processing and return results. We do not own, operate, or control those third-party systems.

Third-party providers may keep their own logs or apply their own retention and security practices. We will make reasonable efforts to assist with privacy requests, but we cannot guarantee deletion or control of data once it is processed by independent providers.

7. Retention

We retain information for as long as reasonably necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Retention can vary by feature and by provider.

  • Account and billing-related records may be retained for compliance and fraud prevention.
  • Uploaded files may be stored temporarily to enable processing; retention may depend on the storage provider and technical constraints.
  • Usage logs may be retained to enforce limits and protect against abuse.

8. Security

We use reasonable administrative, technical, and organizational measures to protect information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Your Rights

Depending on where you live, you may have rights to access, correct, delete, or export certain personal data, and to object to or restrict certain processing. To exercise your rights, contact us at support@podkolay.com.

We may need to verify your identity and may deny requests where permitted by law (for example, where fulfilling the request would compromise security or conflict with legal obligations).

10. Cookies & Similar Technologies

We use cookies and similar technologies that are necessary to operate the Service (for example, to keep you signed in). We may also use preference storage (such as local storage) to remember settings like theme or language.

11. Children

The Service is intended for adults. You must be at least 18 years old to use the Service. We do not knowingly collect personal data from children.

12. Changes

We may update this Privacy Policy from time to time. If we make material changes, we may provide additional notice (for example, in the Service). The "Last updated" date indicates when this Privacy Policy was last revised.
